Terms of Service

These terms are an agreement between you and Brandshine Solutions (“we”, “us”) for the use of Tilty, including our website, web application and the Tilty app for Shopify (the “Services”). By creating an account, installing the app or using the Services, you agree to these terms.

If you use the Services for a business, you confirm that you are authorised to accept these terms on its behalf, and “you” includes that business.

Tilty helps businesses analyse their product catalogues, improve product data and content for AI assistants, search and marketplaces, publish approved changes to connected channels, and measure the results. We may add, change or remove features over time. Some features may be offered in early access and may change or end.

You must be at least 18 and provide accurate information. You are responsible for activity in your workspace, for the people you invite and the roles you give them, and for keeping access to your sign-in account secure. Tell us promptly at admin@tilty.ai if you suspect unauthorised use.

Access to the Services may be by invitation or approval, which we may grant or decline at our discretion.

You keep all rights to your store data, product information and content (“Your Content”), including content generated for you by the Services. You give us permission to access, store, process and transmit Your Content only as needed to provide, secure and support the Services, as described in our Privacy Policy.

You confirm that you have the rights needed to connect your stores and share Your Content with us, and that Your Content and its use through the Services comply with the law and with the terms of the platforms you sell on.

The Services use artificial intelligence to suggest product content based on the information in your catalogue. AI output can be incomplete or wrong. You are responsible for reviewing content before you publish it and for the accuracy of your product listings, prices, claims and policies.

Nothing is published to your store or channels without your action. You can restore your original content for products that Tilty has changed.

You agree not to:

• use the Services for anything unlawful, misleading or harmful, including false or deceptive product claims;
• access stores, accounts or data you are not authorised to use;
• interfere with, overload or attempt to break the security of the Services;
• copy, resell or reverse engineer the Services, or use them to build a competing product; or
• use automated means to access the Services other than through features we provide.

The Services connect to platforms such as Shopify and Google. Your use of those platforms is governed by their own terms, and we are not responsible for their availability, changes or actions, including how AI assistants, search engines or marketplaces rank, display or recommend products.

Fees for paid plans will be shown before you subscribe or are charged. Unless stated otherwise, fees are due in advance, are non-refundable except where the law requires, and exclude applicable taxes. We will give notice before changing the price of a plan you are on.

The Services, including the software, design, brand and documentation, belong to Brandshine Solutions and its licensors. We give you a limited, non-exclusive, non-transferable right to use the Services during your subscription, subject to these terms. If you send us feedback, we may use it without obligation to you.

Each party will protect the other's non-public information that it receives through the Services with reasonable care, and use it only for the purposes of this agreement.

You can stop using the Services at any time by uninstalling the app and asking us to close your account. We may suspend or end access if you breach these terms, if required by law, or to protect the Services or other users. After termination, we delete Your Content as described in our Privacy Policy.

The Services are provided “as is” and “as available”. To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee any particular result, including that your products will be recommended by any AI assistant, ranked by any search engine or chosen by any marketplace, or any increase in traffic or sales.

To the extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability arising out of or relating to the Services is limited to the greater of the fees you paid us in the 12 months before the event giving rise to the claim and USD 100. Nothing in these terms limits liability that cannot be limited by law.

You will defend and indemnify Brandshine Solutions against third-party claims arising from Your Content, your product listings or your breach of these terms, and pay the resulting costs and damages awarded or agreed in settlement.

We may update these terms. We will post the new version here with a new date and tell account holders about material changes in advance. Continuing to use the Services after a change takes effect means you accept it.

These terms are governed by the laws of India. The courts of India have exclusive jurisdiction over any dispute arising out of or relating to these terms or the Services, subject to any mandatory rights you have under the laws of your country.
